The FCC said that it is un-acceptable to put on television because children can easily accesses and be in harm from this language. The FCC lawyer said that if a child just turns on a television and he hears the words said on that music awards show then he might wonder what the F word is and use it to not knowing. Also the F word is not okay because it refers to sexual content, even if they are not using it in content of the word. Also they are saying that they must protect children from this because of the first amendment. Also they are talking about how the FCC did not block the words that they needed to. The back argument was that there is not much harm from hearing a single word. Example: if there is a bubble child would hear the words on that show they would not be completely harmed. Also if they did not want their children to watch bad thing on cable they should not pay money for cable or just use a v chip. Then Mr. Philips says “is people are saying “mother Fucker, eat shit and fuck the America.” And walks away from them and says those aren’t indecent.” So the question in this case is asking “Is the FCC's order imposing liability on Fox Television Stations for fleeting expletives spoken during two nationally broadcast awards ceremonies is "arbitrary and capricious" under the Administrative Procedure Act, based on the FCC's previous acceptance of similar expletives?” Majority opinion; A short summary(Limited to 672total characters) Splitting 5-4, the Supreme Court on Tuesday upheld the government’s power under existing law to ban the use on radio and TV of even a single four-letter word that is considered indecent — but left open the question of whether the ban might violate the First Amendment, at least in some situations. The Court, in an opinion by Justice Antonin Scalia, said the Federal Communications Commission’s switch in policy to ban even a fleeting use of such a word was “entirely rational” under the law that governs federal administrative powers. The opinion referred to the banned words as the “F-word” and the “S-word” but not go on to fill out their actual spelling.
